I dare anyone to find reports in the news medias about the proposed Domestic Terrorism Prevention Act being pushed by the Democrats.
On the surface it sounds like a good idea in light of last summer and the events of January 6th. Except, there is one small problem: We already have laws about domestic terrorism. Specifically, Section 2331(5) of the criminal code already defines domestic terrorism and provides for very stiff penalties. It defines activities within territorial United States that are a “danger to human life,” “that violate state of federal law, and that are intended to accomplish one of the three objectives: 1) To intimidate or coerce a civilian population, 2) to influence government policy by intimidation or coercion, or 3) to affect government conduct by mass destruction, assassination, or kidnapping.
There are NO exceptions!!!
It makes no difference whether it is conducted by white supremicists, jihadists, BLM, Antifa, or any other group. If it fits the above definition it is domestic terrorism and treated accordingly. Last summer’s rioting in many of our cities meets the standards of the law.
If we have one already why do we need another one?
Well, as usual, the Democrats are taking what is working fine and bolloxing it up. This time, their proposed bill redefines domestic terrorism while carving out exemptions for specific categories of terrorists.
What is the exception? Let me give you an example of the wording:
“does not include acts perpetrated by individuals associated with or inspired by (A) a foreign person or organization designated as a foreign terrorist organization…; (B) an individual of organization designated under Executive Order 13224 [which relates to foreign terrorists and foreign entities…; or (C) a state sponsor of terrorism.”
Let me translate:
If a Muslim in the United States commits mass-murder because he was inspired by al-Queda that attack would not be considered domestic terrorism.
Now, you may be asking if that person is already covered under foreign terrorism acts. The short answer is an unqualified NO!!!
Remember Fort Hood, the Pulse nightclub in Orlando, and San Bernardino? The Justice Department resisted labeling the attacks as foreign terrorism because the Muslim assassins did not have operational ties to foreign terrorist organizations. In other words, if the terrorist is just inspired by foreign organizations they do not come under the category of foreign terrorists. Under the existing Section 2331 they are clearly domestic terrorists. But, under the New Democratic proposal, they would be excepted.
To date, the Justice Department has not strongly enforced Section 2331 because numerous federal and state laws already handle many of these situations. But, this new law would allow the Biden Justice Department to focus on one type of definition of domestic terrorists: white supremacists and Neo Nazis…or at least what they define as such. In other words, right-wing protests. Their new law would require that domestic terrorism units be created within the Department of Homeland Security and the Justice Department. These new units, as well as a “Domestic Terrorism Executive Committee” within the FBI would need to file semi-annual reports for the next 10-years showing how many cases are prosecuted and future ways to combat it. It also proposes training for state and local, and tribal law-enforcement for detecting terrorists. All but, as shown, American-based jihadists. IN other words….right-wing protestors. Again, to quote from the bill:
“include an assessment of the domestic terrorism threat posed by White supremacists and new-Nazis, including White supremacist and Neo-Nazi infiltration of Federal, State, and local law enforcement agencies.”
Now, what is not clear is the definition of “White supremicists.” The phrase never used in the report is “sharia supremicism.” All this is doing is pushing a narrative.
Also missing is “radical left,” “Antifa,” “Black Lives Matter militants,” “communists,” “anarchists,” and “enviro-terrorists.”
It is no secret who is all for this proposal.
Under the proposed Domestic Terrorism Prevention Act of 2021 Democrats would give jihadists and left-wing militants a pass while appeasing their interest groups and add to more division in an already deeply divided nation. This is what the Biden administration is calling “uniting the country.”
